Everyone’s favorite State Department special agent Chris Deedy still has no trial date set for his shooting and killing of a Hawaiian man last November while in the islands as part of Hillary Clinton’s guest appearance at the APEC Summit.

(Recap here; Deedy shot a guy, guy is dead. Question is whether the killing was part of Deedy’s law enforcement duty or some version of murder. The whole thing was videotaped by a McDonald’s surveillence camera. The video has not been made public.)

The Honolulu Star Advertiser (slogan: “Steadfastly Not Really Online”) print edition tells us that the most recent legal move took place August 8, when a Hawaiian court denied Deedy’s request to shift the trial to Federal court and outside of state jurisdiction. Next up is a hearing now set for October 22 where Deedy’s lawyer will seek a motion to dismiss, claiming that Deedy acted in his legitimate law enforcement capacity and in self-defense.

No date has been set to begin the actual trial. Dead guy is still dead.

    Questions. Jump in, crowdsourcers:

    – WTF? A guy is dead, we know who done him. There are multiple witnesses. The whole thing is on video. Why is no trial date set ten months after the fact? How the hell much more evidence do you need to bring this to a decision?

    – Given the WTF angle, why why why is this case being delayed? As best we know, Deedy is alive and well, back in Virginia, still on the payroll with the State Department but on some form of not-so-special agent duty. It seems in the public interest to resolve his status. If he is innocent, then let’s pay him with our taxpayer bucks to get back to his real work. If he is guilty, let’s take him off the street.

I know all about “island time, brah,’” the Hawaiian version of manana, later, we’ll get to it, but this all seems beyond that. I am in too good a mood today to bark “conspiracy theory,” but anybody got anything else?

(Thanks to We Meant Well Hawaiian operative “5-0″ for the local paper scans)

“Given the WTF angle, why why why is this case being delayed?”

Since the plan to outsource the case to the Federal court failed, Deedy’s team could be planning Plan B: http://en.wikipedia.org/wiki/Graymail

Maybe DS is waiting for Romney to be elected and totally gut the rule of law. However, if Deedy tortured the guy first…

Somebody needs to look into DS training, specifically the “anti-terrorist” driving. DS used to hype this, each agent had to do “bootlegs and j-turns” to pass the special agent course. They did this test on special stock cars at the Bill Scott raceway in West Virginia.

Turns out doing these at BSR is one thing, and doing them in a big armored SUV is quite another. Apparently a few people actually got killed in Iraq when they tried to perform these stunts in real life, nobody having noticed that the physics of doing these in big armored SUV’s is quite different than a souped-up stock car.

I don’t know if they convened accountability review boards on this. Someone needs to look at this. Sadly, the only other investigative body at State is the Inspector General, which, in the words of a bad Clint Eastwood movie, “couldn’t convict Hitler.”

Why don’t we all drop “everyone’s favorite State Department special agent” a line and let him know we’re thinking of him: deedycw@state.gov. I’m 95% sure this is the correct email address.

There is another side to this story, which you seem committed to ignoring despite having blogged on this subject for month… A drunk, racist local starts harassing people in the local McDonalds. Agent Deedy chooses to do the right thing and intervene to encourage the local ass wipe to behave and then finds himself in a fight for his life. (See: http://www.policemag.com/channel/patrol/articles/2012/08/convicted-in-the-media.aspx)

You don’t have to believe the above narrative, but you are doing yourself and your readership a disservice by summarily dismissing it and only linking to other beef-brained bloggers who have already decided they have all the facts even though the trial hasn’t even started.

In reference to previous discussions on this site, it isn’t clear whether Deedy was drunk, it is very clear that the antagonist Deedy shot was hammered. Moreover, even if Deedy had been drinking it doesn’t mean he acted inappropriately. If the “victim” started the altercation by acting like an aggressive prick and Deedy was put in a situation where he was at risk of grave bodily harm or even death, then he was justified in defending himself with his weapon.

It’s an idiotic distraction to focus on whether Deedy was on-duty or off-duty. He’s an 1811 agent, which means he’s never truly off-duty. And just because Secretary Clinton wasn’t eating a Big Mac in the back of the restaurant where the shooting took place doesn’t mean he had no moral obligation to control a dangerous situation.

And to the moron who is encouraging people to send Deedy hate mail — do the world a favor and stay away from your keyboard. Deedy is on trial for his life, he doesn’t need some ass clown contacting him to express righteous indignation over the fact that he hasn’t been tarred and feathered, yet.

The POS shouldn’t been out harassing citizens. Deedy was only defending his life and this case never should have started.

It’s also an idiotic distraction for certain bystanders and media to whine about Elderts being “unarmed”. Deadly force in self-defense is not predicated on whether the assailant is armed. There is no legal requirement to take a beating or incur undue risk to one’s well-being prior to the use of deadly force in self-defense.

Fix Hawaii’s unconstitutional gun laws that turn victims into criminals and criminals into victims, and before too long there might finally be a growing culture that eschews the Hollywood “everyone’s a victim” mentality in favor of empowering true Citizens with personal responsibility and civic duty.

I know the guy who died. He was what some can call a punk but he had a good heart. He was too young to die. But I pity deedy as well. However as a trained agent there to protect a Clinton, he shouldn’t have had to draw his weapon. Maybe he should have just walked away.
